APPLICATION
These general and specific terms and conditions form an integral part of the agreement between the parties and apply to every commercial transaction and delivery unless otherwise agreed in writing beforehand. The buyer explicitly accepts our general and specific terms and waives all contradictory terms, including their own purchase terms.

Article 1: QUOTATION
Offers are always non-binding. No order, whether made directly or through our representatives, is valid unless confirmed in writing.
The contract is concluded only upon written confirmation of the sale within one month. Placing an order implies acceptance of the terms.

Article 2: ORDER
Any order exempt from customs duties and VAT must be submitted with an original copy of the investment file approved by the authorities and a VAT exemption certificate issued in the name of BRICOSTAR.
Orders from account customers must include a purchase order dated, signed, and stamped, stating the company name and address.
Invoices will be issued monthly for all purchase orders.

Article 3: PRICE
Due to uncertainties in raw material prices between the order and its execution, prices are indicative only. The final prices are those in effect on the delivery date according to the customer’s purchase order.

Article 4: Return of Goods and Warranty
All products have undergone standard factory testing. Additional tests requested by the buyer are at their expense.
Goods are not returnable definitively.
If a manufacturer’s warranty exists, the manufacturer is responsible for repairs or replacements per the warranty terms, upon presentation of the warranty documents.
BRICOSTAR provides no warranty unless explicitly issued by the product manufacturer.

Article 5: Payment Terms
Delivery triggers billing. Unless otherwise specified, full payment is due immediately without discount.
Late payments accrue legal interest automatically.
If multiple payments are agreed and one is missed, the remaining balance becomes due immediately. The seller may suspend or cancel the order until full payment is received.
In case of buyer insolvency, bankruptcy, or other financial issues, the same conditions apply.
The seller retains ownership of the goods until full payment. Payments on the site BRICOSTAR are made by credit card (Visa, Mastercard, or CMI card) via the secure platform of the Centre Monétique Interbancaire (CMI). The buyer guarantees that they have the necessary authorizations to use the chosen payment method. The security of the transaction is guaranteed by CMI through high-level encryption and 3D Secure authentication.

Article 6: Delivery Times
Delivery times are indicative. Delays do not entitle the buyer to penalties or compensation.

Article 7: Transport
Transport may be handled by the seller but always at the buyer’s cost and risk.

Article 8: Disputes
All disputes not resolved amicably shall fall under the exclusive jurisdiction of the Commercial Court of Tangier.
